The following terms and conditions apply to all services, including website design and development provided by MakeWebsite to the Client.
This agreement serves as a legal and binding document, applicable to all services offered by MakeWebsite.
MakeWebsite will send the client an email with a project quotation outlining the charges for the services to be rendered. The quotation is valid for 30 days, after which MakeWebsite reserves the right to modify or replace it.
For all website services, a prepayment of 50% of the total project quotation is required before the project can begin. The remaining 50% must be paid upon completion of the work before uploading or releasing materials to the server.
Written Content must be supplied by the Client in the formatted text as the Client specifies it to appear on your website.
Text content must be delivered in digital formats such as MS Word, Google Docs, or PDF.
Acceptable file extensions are: .doc; .docx; .gdoc; .pdf.
Should the customer want to hire us for quality content writing service or need help with the photographs, this will come as extra charges.
The Client shall supply all Graphic Images to be published by the specified products and services.
Photographs supplied by the Client must be of high digital quality and applicable format.
Graphic images are considered as the logo, artwork, icons, wallpaper, or anything not a photograph, but in an image file format. There is a lot of useful free images available on the internet, so you can save yourself a lot of money if you have the time to browse through millions of images.
However, we offer graphic design services at a cost should you need higher quality professional, unique design.
All graphic image files must be supplied in digital format. There are three categories of image files, namely: static, transparent and animated. Ensure the correct file format for how you intend the image to be used.
- Acceptable file extensions are: .png; .jpg; .jpeg; .bmp
- Pixels for image files should not be less than 700X700 nor exceed 2000X2000 pixels (in both instances width X length indicates the maximum and not the relation of width to length).
- Resolution for images should be no more than 300 DPI. 72 DPI is what is typically used on websites.
The Client has to provide MakeWebsite with their Cpanel login information.
MakeWebsite will not be held liable or have any responsibility for the Client’s Hosting Services via a Third Party Service Provider as we do not have control over the status of hosting, domain renewals or e-mail when not hosted with us (MakeWebsite).
All technical aspects of websites must be referred to the Client’s Third Party Hosting Service Provider.
MakeWebsite will however assist the Client upon request with Third-Party Hosting Service Provider(s). This time may be billed to the Client at the discretion of MakeWebsite.
MakeWebsite can not guarantee search positions or rankings of websites but include Search Engine Optimisation (SEO) in the form of meta tags and descriptions, structure and basic content recommendations.
The Makewebsite Website is © 2019 Makewebsite – All Rights Reserved. No portion of the Website may be copied, reproduced, transmitted, derived, or otherwise used for any purpose without the prior written permission of Makewebsite.
The Client is required to e-mail Proof of Payment to MakeWebsite, which will be reciprocated with a Statement, allocating payment to said Invoice, to the Client, when said funds are confirmed by MakeWebsite.
All work remains the property of MakeWebsite until the full and final payment is received.
Activation of the Client’s website is conditional to the Terms &Conditions
The Completion Date of a project is affected by feedback and received content from the Client. Time-frames will be adjusted within reason, notwithstanding these Terms & Conditions.
The Client will be notified when the website is activated, and then the Client will have two working days to report any faults or request minor alterations in writing by e-mail.
Should MakeWebsite not receive a reply within 2 (two) working days via e-mail, the Client’s website is considered finalised and complete. Therefore, WebSiteDesigns take no responsibility for website content errors hereafter.
Please note that any further adjustments or amendments after this date will be at an additional cost and will be sent in an invoice.
It is not necessary for any Client to have signed an acceptance of these terms and conditions for them to apply. If a Client accepts a quote then the Client will be deemed to have satisfied themselves as to the terms applying and have accepted these terms and conditions in full.
Please read these terms and conditions carefully. Any purchase or use of our services implies that you have read and accepted our terms and conditions.
Failure to comply with these Terms and Conditions regarding payments and fees will result in legal action from MakeWebsite legal representative(s), and the full outstanding balance becomes payable.
All legal costs resulting from non-payment will be accrued to the Client’s outstanding balance.
The Client has to ensure they have the Copyright for all material supplied.
You guarantee that all elements of text, images or other artwork you’ve provided are either owned by you, your company or that you have permission to use them.
MakeWebsite will not be liable or held responsible for any copyright disputes.
If and when WebSiteDesigns are informed that material was provided without the required Copyright, illegal content will be removed immediately.
We can’t guarantee that our work will be error-free, and so we can’t be liable to you or any third party for damages, including lost profits, lost savings or other incidental, consequential or special damages, even if you’ve advised us of them.
Should the Client cancel the project at any time, all fees up to that point of work will be calculated. Any amount greater than the 60% deposit will be billed to the Client. This is payable within 7 (seven) calendar days of the invoice date.
Hosting and Domain Fees are non-refundable, as these are paid in advance.
MakeWebsite reserves the right at its discretion to cancel this Agreement should the Client breach any of the Terms and Conditions stated herein.
MakeWebsite will not be held liable for any viruses, hacking, malicious content or any Security breaches pertaining to any third-party applications or to the Client’s website.
MakeWebsite hosting service provider may at any time suspend a domain should any viruses or malicious content be exposed through hacking or security breaches to any third party application or website.
MakeWebsite makes every effort to ensure websites are designed to be viewed by the majority of visitors. Websites are designed to work with the most popular current browsers (e.g. Firefox, Internet Explorer, Google Chrome, etc.).
A link to MakeWebsite will appear in either small type or by a small graphic at the bottom of the Client’s website. If a graphic is used, it will be designed to fit in with the overall site design. If a Client requests that the design credit be removed, a nominal fee of 10 per cent of the total development charges will be applied.
The Client agrees that the website developed for the Client may be presented in MakeWebsite’s portfolio, and hereby grants MakeWebsite a worldwide, perpetual, non-exclusive licence to use its name, logo and branding for advertising, marketing and promotional activities.
MakeWebsite may amend these Terms from time to time, at its sole discretion. Such changes will be made available through the MakeWebsite website at the location designated for these Terms.
